x)     Using the service for any purpose that overburdens, or that threatens the integrity, performance, or availability of tickt.cc’s systems or infrastructure.

b)    tickt.cc reserves the right to investigate and take appropriate legal action against anyone who, in tickt.cc’s sole discretion, violates this provision, including without limitation, reporting you to law enforcement authorities.

5)    Intellectual Property Rights

a)     The software, algorithms, and code comprising the tickt.cc platform are the exclusive property of tickt.cc and are protected under international copyright laws and intellectual property treaties. The user acknowledges that tickt.cc and its licensors retain ownership of all copyrights, patents, trademarks, trade secrets, and other proprietary rights associated with the platform, including any modifications, enhancements, or updates to the software.

b)    The user is granted a non-exclusive, non-transferable, revocable license to access and use tickt.cc strictly in accordance with these Terms of Use. This license does not constitute a transfer of title in the software and is subject to the following restrictions:

ii)     The user shall not sell, redistribute, sublicense, or otherwise transfer the software to third parties.

c)     Any use of tickt.cc’s software not in accordance with these Terms of Use is expressly prohibited and may result in severe civil and criminal penalties.

a)     tickt.cc provides its software, algorithms, and code on an “as is” and “as available” basis without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability or fitness for a particular purpose. Use of the platform is at the user’s own risk.

b)    tickt.cc does not warrant that the software will be uninterrupted or error-free, nor does it make any warranty as to the results that may be obtained from the use of the software, or as to the accuracy, reliability, or content of any information provided through the software.

c)     To the fullest extent permitted by applicable law, tickt.cc shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if tickt.cc has been advised of the possibility of such damages), resulting from:

i)      The use or the inability to use the software;

ii)     Unauthorized access to or alteration of your transmissions or data;

iii)   Statements or conduct of any third party on the service;

iv)   Any other matter relating to the software.

d)    In no event shall tickt.cc’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing or participating in any activity related to the use of the software.

7)    Governing Law and Jurisdiction

a)     These Terms of Use and your use of the tickt.cc platform are governed by and construed in accordance with the laws of the Federative Republic of Brazil, without giving effect to any principles of conflicts of law. By using tickt.cc, you agree to submit to the exclusive jurisdiction of the Brazilian courts for any disputes arising out of or related to your use of the platform and these Terms of Use.

b)    Any claims against tickt.cc arising from the use of the platform or these Terms must be brought within one (1) year of the date on which the event giving rise to such action occurred. All actions shall be subject to the limitations set forth in these Terms of Use.

c)     Users of tickt.cc outside of Brazil acknowledge that they are responsible for compliance with any local laws to the extent that local laws are applicable.
